Acknowledgement of Responsibility *Acknowledgement of Responsibility Before you sign You are electing to meet your anti-money laundering and counter-terrorism financing obligations through your own arrangements rather than through @realty. From the date your removal takes effect, @realty performs no AML/CTF function for you and you answer to AUSTRAC directly. Removal from @realty's AUSTRAC reporting group takes up to 14 business days from the date we accept a complete form. Signing this form does not remove you. The 14 business days does not begin until any missing information or evidence has been supplied. You remain a member of the @realty reporting group, with all obligations continuing, until we confirm your removal to you in writing. I acknowledge and agree that: 1. I am authorised to make this election on behalf of the reporting entity named in this form. 2. I elect to meet my AML/CTF obligations through my own reporting entity and external arrangements, and not through the @realty AML/CTF pathway. 3. From the date my removal takes effect I am no longer covered by @realty's AML/CTF process — including @realty's AML/CTF program and policies, @realty's AUSTRAC reporting group, the AML/CTF DBU Services Agreement, any @realty-provided AMLHub subscription or verification platform access, @realty's AML/CTF training, and @realty's compliance monitoring and support. 4. I am solely and independently responsible for every AML/CTF obligation that applies to the designated services I provide. This includes enrolling and remaining enrolled with AUSTRAC; developing, maintaining and reviewing an AML/CTF program comprising a money laundering and terrorism financing risk assessment and AML/CTF policies; appointing an AML/CTF Compliance Officer; conducting initial, ongoing and enhanced customer due diligence, including identifying beneficial owners and screening for politically exposed persons and sanctions; lodging suspicious matter reports within the required timeframes; lodging threshold transaction reports, annual compliance reports and any other prescribed reports; complying with the tipping-off prohibition; keeping records for at least seven years; conducting personnel due diligence and AML/CTF training; arranging independent evaluation of my program; and responding to AUSTRAC. 5. @realty will not conduct customer due diligence or identity verification for me or my customers, lodge any report to AUSTRAC on my behalf, maintain my AML/CTF program or records, monitor or audit my compliance, or respond to AUSTRAC on my behalf. 6. @realty head office support will decline AML/CTF requests relating to my transactions — whether from me, my clients, my team members, conveyancers, solicitors or any other third party — and will refer them to me or my provider. 7. I will not represent to any customer, third party, portal, regulator or AUSTRAC that my AML/CTF obligations are performed by, covered by, or shared with @realty, and I will not use @realty's AUSTRAC Account Number, AML/CTF program or compliance materials. 8. My external arrangements are, or will be, operational from the removal date confirmed by @realty, and there will be no gap in coverage. 9. I consent to @realty removing me and my reporting entity from the @realty AUSTRAC reporting group, notifying AUSTRAC of that removal, cancelling any @realty-arranged AMLHub subscription or platform access held for me, and recording my status as an external provider. 10. Removal from the @realty AUSTRAC reporting group takes up to 14 business days from the date @realty accepts a complete form. Submitting or signing this form does not itself remove me, the 14 business days does not begin until any missing information or evidence has been supplied, and I will not treat myself as removed until @realty confirms my removal in writing. 11. Until removal is confirmed I remain a member of the @realty reporting group, my AML/CTF obligations continue without interruption during that period, and it is my responsibility to ensure my own AUSTRAC enrolment and external arrangements are operative on or before the date removal takes effect so that I am never providing a designated service without cover. Any gap in cover is my responsibility, not @realty's. 12. My obligations in respect of designated services already provided, and records already created, survive this election, and I remain responsible for retaining and producing those records. 13. I will notify @realty in writing within 5 business days if my external arrangement lapses, is terminated or materially changes; if my AUSTRAC enrolment is cancelled, suspended or refused; or if I become subject to AUSTRAC enforcement action, a remediation direction or an enforceable undertaking. 14. I will provide @realty with evidence of my AUSTRAC enrolment and current AML/CTF arrangements on request. 15. I release @realty and its related entities from any liability arising from my AML/CTF compliance or non-compliance from the date my removal takes effect, and I indemnify @realty and its related entities against any loss, damage, penalty, fine, cost or expense (including reasonable legal costs) they suffer or incur as a result of my failure to comply with the AML/CTF Act, the AML/CTF Rules or this declaration. 16. A failure to hold and maintain compliant AML/CTF arrangements may constitute a breach of my agency agreement with @realty, and @realty may suspend or withdraw services until compliant arrangements are demonstrated. 17. If I later wish to return to the @realty AML/CTF pathway I must apply to do so, complete the AML/CTF DBU Services Agreement and satisfy all onboarding requirements. Re-entry is not automatic, is at @realty's discretion, and re-joining the reporting group is also subject to AUSTRAC processing time. 18. This form is provided for general information only, is not legal advice, and I have had the opportunity to obtain independent legal advice before signing. 19. The information I have provided in this form is true, accurate and complete. 20. I consent to signing this declaration electronically, and agree my electronic signature has the same legal effect as a handwritten signature. 21. I consent to @realty collecting, storing and using this information for compliance, audit and record-keeping purposes, and disclosing it to AUSTRAC or a regulator where required by law.
